Kennedy joined with the right wing of the court to validate their claim.
Justice Ginsburg's read her dissent aloud in court.
I'm wondering if the following line from her dissent was delivered as snarkily as it sounds:
The white firefighters who scored high on New Haven’s promotional exams understandably attract this Court’s sympathy. But they had no vested right to promotion.
I certainly hope so.
Late edit: in her oral delivery of her dissent, Justice Ginsburg used the word "empathy" in place of sympathy. Double snark!

note to self #1: get the diverse, experienced examination review board to review the freaking exam before examinees begin their preparation.
note to self #2: the 'examination review board' may not comprise the most recent examinee cohort.
in case we need to be reminded that 'a stitch in time saves nine'.

Yeah, NPR was saying that this decision will actually have a pretty limited effect in the long term. Not very many municipalities will find themselves in this situation of “getting sued because you dumped test to avoid being sued” – but then if they do, odds are they won’t be flushing their test results.
You dance with the test that brung ya.
